Open Burn Permits
The complete list of provisions and exceptions for open burning are outlined in Section 8-4 of the Kansas City, Mo., Air Quality Code.
Burn Permits must be obtained in person from the Air Quality Program at:

The following method of open burning is authorized by city code.
- The Air Quality Program may restrict or suspend open burning on Red Ozone Alert.
- Material to be burned must only be trade waste defined as felled timber, ornamental trees or natural vegetation.
- All portions of the combustible material must be enclosed within the burning area.
- The device must be located no closer then 300 yards from the nearest inhabited structure.
- If the burn pit is constructed between 200 and 300 yards from an inhabited structure, signed waivers from all residents/owners within this area must be obtained.
- At no time may a burn pit be constructed less then 200 yards from an inhabited structure.
- Burning may only be done between 8 a.m. and 4 p.m.
- Burn pit location is to be changed after 30 hours of operation or sooner if the side walls of the pit collapse.
- The permittee may be temporarily required to cease burning if the director of Health or his duly appointed representative for any reason without prior notification of the permittee.
- Rubber tires or fuel oil may not be used to start or assist burning.
Air curtain devices are used to minimize the particulate matter released during the burning process and must be used in Kansas City. The following photos are an example of a burn pit and air curtain device used to burn vegetation at a construction site.
