This Covenant is executed on the date of __________, in the City of Kansas City, Mo. The undersigned, in consideration of being permitted to maintain ___________________ (street) for litter control and/or beautification, does release, waive, discharge and covenant not to sue the City of Kansas City, Mo., from all liability to the successors, and assigns, for all loss or damage, and any claim of damage therefore, on account of injury to person or property resulting from the granting of this permit. The undersigned further agrees that as against the undersigned or their successors or assigns, this instrument may be pleaded as a counterclaim to or as a defense in bar or abatement of any action of any kind whatsoever, brought, instituted or taken by or on behalf of the undersigned on account of said supposed claim or claims against the City of Kansas City, Mo. The undersigned agree to indemnify and hold harmless the City of Kansas City, Mo., and its agents and employees, from and against all claims, damages, losses and expenses arising out of the performance of the work covered by this agreement.
